AI Labelling Will Not Authenticate an Identity Document
What the EU Artificial Intelligence Act's transparency rules do — and do not — tell you about whether a passport, driver licence or national identity card is genuine
New European Union rules require certain AI-generated content to carry visible disclosures and machine-readable markings. These measures may improve transparency, but they do not establish that a passport, driver licence or national identity card is genuine. As synthetic document fraud becomes more sophisticated, identity validation must rely on layered controls spanning the document, issuer records, biometrics, device and transaction.
- AI labels are indicators, not proof of authenticity: an unlabelled document may still be synthetic, altered, stolen or fraudulently presented.
- Identity validation requires layered detection: document analysis should be combined with authoritative data checks, biometrics, liveness and transaction-risk assessment.
- Manual examination remains relevant: IDV Pacific now supports optional referral for a separate third-party opinion when automated results are inconclusive or transaction risk warrants further review.
What Do the New EU AI Labelling Rules Require?
The RMIT Information Integrity Hub recently examined new European Union transparency requirements for AI-generated content in its article, "Mandatory AI warnings land in the EU. Will they work?"
Introduced under Article 50 of the EU Artificial Intelligence Act, the initiative requires applicable AI systems to notify users when they are interacting with AI. Generative AI outputs — including text, images and audio — must also carry machine-readable markings, while certain deepfake content must be visibly disclosed.
The intended result is greater transparency: consumers and digital platforms should have more information about whether content has been generated or manipulated by AI.
However, the RMIT article also identifies limitations:
- Labels and embedded metadata can be removed.
- Markings can be lost during editing, or stripped when files are processed by online platforms.
- Malicious actors are unlikely to preserve disclosures that identify their material as synthetic.
Can an AI Label Prove an Identity Document Is Genuine?
IDV Pacific supports measures that improve the provenance and traceability of digital content. We remain sceptical, however, about treating AI labelling as a meaningful authentication control for passports, driver licences and national identity cards.
A label can indicate that a participating AI system generated or processed a file. It cannot confirm that the document is what it claims to be.
A label cannot confirm that the document:
- was issued by the stated authority;
- remains valid;
- belongs to the person presenting it; or
- has not been altered.
The absence of a label provides even less assurance. A fraudulent document may have been created using an unregulated model, conventional editing software or specialist document-production tools. Metadata may also have been removed deliberately or lost through scanning, screenshots, compression and file conversion.
IDV Pacific is observing increased incidence and sophistication of fraudulent identity documents across our customer base. This includes manipulated document images, synthetic identity data and presentation techniques intended to defeat automated onboarding controls. The operational question is therefore not simply whether a file was made using AI, but whether the document and the person presenting it can be independently verified.
What Controls Make Up a Layered Identity Verification Process?
The Australian Digital ID framework applies progressively stronger identity-proofing requirements as the consequences of misidentification increase. Higher-assurance levels combine verified documents, multiple identity sources, biometric comparison and, where required, in-person examination.
This aligns with IDV Pacific's layered approach. A defensible remote identity-verification process should include:
- Document classification and analysis of structural and security features.
- Verification against authoritative issuer records, such as Australia's Document Verification Service.
- NFC chip authentication for compatible ePassports.
- Cryptographic validation of mobile and digital credentials.
- Facial comparison against the document or authoritative issuer image.
- Liveness, presentation-attack and injection-attack detection.
- Device, session, behavioural and transaction-risk analysis.
- Manual referral when automated signals conflict or require further examination.
No individual control is sufficient. Together, these measures make document fraud more difficult to scale and provide evidence for risk-based acceptance, rejection or referral decisions.
New: Optional Manual Referral Examination
IDV Pacific now also supports an optional manual referral examination. Where a document produces inconclusive results or warrants additional scrutiny, it can be referred for a separate third-party opinion to supplement the automated assessment.
What Does This Mean for Organisations Verifying Identity Documents?
EU labelling may contribute another useful risk signal, but it should not be relied upon to establish document authenticity. IDV Pacific clients should continue to apply layered identity controls appropriate to the consequences of misidentification.
An AI label describes how a file was made. It does not establish that the document was genuinely issued, that it remains valid, or that it belongs to the person presenting it.
In practice this means combining automated document validation, authoritative data verification, biometrics, liveness and transaction analysis, with manual referral available where the evidence does not support an automated decision.
